  • Divorce - Going through a divorce can be a very painful experience. In fact, some professionals rate divorce as more stressful than the death of a close family member, jail, being fired, and just about any other life event. Beyond the emotional issues involved, there are numerous legal questions that must be determined. A “Dissolution of Marriage” must be obtained, assets must be classified and divided, and spousal support may be ordered. When the divorcing parties have children together, there are also custody, visitation, and child support issues to be resolved. In some cases, if one party causes the divorce to be unnecessarily difficult, he or she must pay the other party’s attorneys’ fees.

  • Common Law Marriage – Alabama recognizes common law marriages. The most weight in deciding if there is a common law marriage is if a couple lives together, identifies themselves as a married couple, and intends to be married. Once a common law marriage is established between two people, the state officially recognizes the union and the couple receives the same legal treatment as formally married couples. This means a couple wishing to end their marriage must obtain a legal divorce. We can make sure your rights are protected through the dissolution of a common law marriage.
  • Custody and Visitation – Nothing in a divorce is more difficult or complex than the issues of child custody and visitation. When spouses obtain a divorce, the court determines which spouse will have custody of any children of the marriage and arranges a schedule of visitation with the other spouse. We can help you protect your parental rights and obtain a custody arrangement that is in your best interests and the best interests of your child.
  • Child Support – Both parents are responsible for the financial support of their child, regardless of whether the parents were married during the child’s birth. Once the parentage of a child has been established, a court can issue an order requiring either or both parents to provide financial support for their child’s living expenses, education, health, and other needs. We can help a parent obtain support, or defend against an unwarranted claim for support.
  • Alimony / Spousal Support – In many cases of divorce, one of the spouses will be ordered by the court to financially support, or pay alimony to, the other. The court can order payments to be made in a lump sum, periodically, based on a percentage of the other spouse’s income, or in any other way the court finds proper considering all of the circumstances. Spousal payment arrangements are rarely permanent, and will usually end after a period determined by statute, or when the court finds that the dependent spouse has become independent.
  • Modifications – The court will not modify any family law order unless the party wishing to modify the order can present facts that arose after the order was issued, which were not known to the court at the time, or that show changes have occurred in the needs of the child or the child’s custodial parent. For example, changes may be made if the current arrangement becomes detrimental to the child, or because a parent has remarried, moved, or increased his or her earnings. If your original divorce agreement no longer reflects your current circumstances, we can help you seek an amendment.
  • Finding Missing Spouses – We work with the appropriate agencies to find missing spouses who may be neglecting their support obligations. In order to minimize the stress of this difficult situation, we handle all of the necessary paperwork and communicate with the federal government, including the Internal Revenue Service (IRS), to enforce our clients’ rights.
  • Adoptions – Adoption transfers parental rights from the birth parent to the adoptive parent. Adoptions require filing a petition in court, in addition to a myriad of other steps and procedures. Whether you are participating in an agency adoption, independent adoption, or stepparent adoption, we can simplify and expedite the process for you.
  • Paternity – We assist clients with support and visitation issues where the parents have never married. Once legal paternity is established, a father is obligated to support his child, and he also gains the right to share in custody or have visitation rights. We can help you establish, challenge, or disestablish paternity depending on your needs.
  • Grandparents’ Rights – In Alabama, a grandparent may have certain rights and responsibilities for their grandchild. For example, grandparents may seek visitation rights with a minor child during a divorce, or in the event of the death of one or more of the child’s parents. In all situations, the court will look at what is in the best interest of the child and make a decree accordingly.

Probate / Estate Administration – After a loved one has passed away, we assist their family with probate administration, the legal process by which any debts of the decedent are paid and the decedent’s estate is distributed to his or her heirs as set forth in the will, or if the person died without a will, in accordance with Alabama’s laws governing intestate succession. Sometimes a dispute will arise as to whether a will is valid or if the executor of the estate is properly performing his or her duties. We have the legal acumen and resources to successfully resolve such cases.
